FYMIND / LEGAL
Terms of Use
These terms govern your access to and use of FyMind, a financial planning and scenario-exploration product provided by Veliquon Solutions Pty Ltd.
1. Agreement
These Terms apply between the user and VELIQUON SOLUTIONS PTY LTD in relation to FyMind. By creating an account or using FyMind, the user agrees to these Terms and the Privacy Policy.
2. Nature of FyMind
FyMind is a prediction-based financial planning and education tool. It is not a financial, investment, tax, legal, accounting, credit, mortgage, insurance, superannuation, property or retirement adviser and does not provide regulated financial product advice.
3. Estimates
Calculations, projections, reports, scores, alerts and simulations are estimates only and may be incomplete, outdated or unsuitable because of inputs, assumptions, market changes, law, tax rules, rates, inflation, provider data or technical faults. No future result is guaranteed.
4. User responsibility
Users are responsible for information entered and decisions made. Outputs must be independently checked and appropriately qualified professional advice obtained before material financial, property, borrowing, insurance, tax, legal, business, employment or retirement decisions.
5. Accounts and security
Users must provide accurate account information, protect credentials and report suspected unauthorised access. Users must not access another user’s data, bypass controls, misuse admin functions, interfere with security or use FyMind unlawfully.
6. Monthly and yearly subscriptions
FyMind is provided through paid monthly and yearly subscription plans. Current prices, plan inclusions and any introductory offer are displayed in Google Play or the Apple App Store before purchase. Subscriptions renew through the applicable app store unless cancelled in accordance with its rules. Payments, renewals, cancellations and refunds are also governed by Google Play or Apple. Paid access is granted only after a valid store entitlement is verified. Deleting a FyMind account does not automatically cancel an app-store subscription.
Versioned cloud backup and restore is available only where included in the user’s verified plan. Backup limits, retention periods and availability may vary by plan or service capacity. Users should review the displayed backup date before restoring. Restoration replaces the supported financial-planning data in the account with the selected snapshot and does not replace identity, billing, security, audit or support records. FyMind creates a safety snapshot before a restore, but users should also keep independent exports of important information.
7. Third-party services
FyMind may depend on providers for hosting, databases, email, app stores, advertising, consent, analytics, crash reporting, notifications and security. Those services may be unavailable or change. Responsibility for matters outside the company’s reasonable control is limited subject to rights that cannot be excluded.
8. Acceptable use
Users must not introduce malware, abuse billing/referral systems, scrape or overload services, impersonate others, probe for vulnerabilities without authorisation, or infringe rights. Reverse engineering is prohibited except where law expressly permits it.
9. Intellectual property
FyMind software, branding, interfaces, content and documentation are owned by or licensed to VELIQUON SOLUTIONS PTY LTD. Users receive a limited, personal, revocable and non-transferable right to use the service under these Terms and app-store rules. Users retain ownership of information entered and grant the limited rights needed to operate the service.
10. Availability and changes
Features, prices, trials, integrations and calculations may change or be suspended for maintenance, security, compliance, provider limitations or business reasons. Uninterrupted or error-free availability is not guaranteed.
11. Liability and consumer rights
To the maximum extent permitted by law, VELIQUON SOLUTIONS PTY LTD is not liable for losses arising from inaccurate inputs, assumptions, reliance on estimates, market/legal changes, third-party services, outages, account compromise or use contrary to these Terms.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.
12. Termination and deletion
A user may stop using FyMind and request deletion through the FyMind account deletion page. Access may be suspended or terminated where reasonably required for security, unlawful activity, material breach, fraud, non-payment or protection of users and systems.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. Subject to mandatory rights and jurisdictional rules, the parties submit to the courts of New South Wales.
